An EU Responsible Person is the EU-based business named on your product as its safety contact. Sellers based outside the EU need one before they sell there; sellers outside the UK need a UK Responsible Person for Great Britain. The Responsible Person holds your product documentation and answers the market surveillance authorities. What Is an EU Responsible Person?

An EU Responsible Person is a natural or legal person established within the EU who takes responsibility for your product's compliance with relevant EU regulations. Under the General Product Safety Regulation (EU) 2023/988, a consumer product may only be placed on the EU market if an economic operator established in the EU is responsible for it. For a manufacturer outside the EU, that is usually the Responsible Person.

Your EU Responsible Person holds your technical documentation, responds to requests from market surveillance authorities, and ensures your products carry the correct compliance markings. They are your legal presence in the EU — even when your company is based in the UK, US, China, or elsewhere.

For cosmetics specifically, the EU Responsible Person role is defined under Regulation (EC) No 1223/2009. This is a separate regulatory basis with additional obligations including holding the Product Information File and managing CPNP notifications.

Who Needs an EU Responsible Person?

Every business selling consumer products into the EU from outside Europe needs an EU Responsible Person. There are no exceptions for small businesses or low sales volumes.

This applies to UK sellers (post-Brexit, the UK is a third country under EU law), US brands, Chinese manufacturers, Turkish producers, and businesses from any other non-EU country. If your products reach EU customers — whether through Amazon, Shopify, eBay, or your own website — you need one.

Amazon Sellers

Amazon enforces EU Responsible Person requirements through its GPSR compliance programme. Listings without proof of appointment can be suppressed. Your Eldris certificate is issued within 60 minutes of completing onboarding.

Shopify, eBay & Direct-to-Consumer Sellers

The requirement is not Amazon-specific. The General Product Safety Regulation applies to consumer products sold in the EU through any channel. If EU customers can buy your products, you need an EU Responsible Person.

Which Rules Require It?

Three sets of rules matter. The General Product Safety Regulation (EU) 2023/988 covers consumer products. The EU market surveillance rules require an EU-based operator for CE-marked products. Regulation (EC) No 1223/2009 covers cosmetics, with its own safety assessment and CPNP notification.

What Happens Without an EU Responsible Person?

Without an EU Responsible Person, three things can happen. Amazon can suppress your listings under its GPSR enforcement programme. Customs can refuse entry to your shipments. Market surveillance authorities in any EU country can issue fines and order product recalls.
